Philips Sleep Apnea Machines and CPAP Machine Issues

Phillips recalled millions of sleep apnea machines because many users were breathing toxic foam caused by a defect in the machine. Breathing toxic foam can lead to cancer and other serious health issues. In addition to causing cancer, many users also complained of headaches, upper airway irritations, coughing, chest pain, sinus infections, asthma, liver and kidney damage, nausea, vomiting, and increased breathing problems.

Class Action Lawsuit

Philips was sued in a Massachusetts class action lawsuit in June 2021. Phillips was aware for years that its toxic foam was causing severe health problems for people, according to the lawsuit. Phillips did not issue a public warning until April 2021, even though users complained for many years about the issues. Philips recalled the devices two months later, on June 14th, 2021. Philips announced the recall right around the time they were releasing a newer machine.

The fact that many patients who desperately needed these devices had no choice but to purchase the newer machines means Philips profited even after the recall of their current machines was made public.

Philips Lawsuits Are Based On 2 Violations:

1. Defect in the design

The people suing Philips were doing so because of the dangerous and defective devices the company sold to patients. Using the device could cause cancer because the foam they used is so toxic when it degrades.

2. Failing To Warn

In addition to using dangerous materials in their devices, Philips failed to warn the public as soon as they became aware of the risks. For years, users have complained about health problems caused by the foam. Philips first observed the problem in April 2021, but didn’t issue a recall until the middle of June 2021. The machines continued to be sold and used for at least two months after Philips was aware of the risks.
